Este artículo describe y analiza la doctrina del Tribunal Europeo de Derechos Humanos (TEDH) sobre la identidad de género de las personas transexuales. En el Convenio Europeo sobre Derechos Humanos (CEDH), como en otros tratados internacionales sobre derechos humanos, no existe un derecho que reconozca y proteja la situación del colectivo trans. Resumen: España fue el último de los viejos imperios coloniales en abolir el comercio de esclavos. Inglaterra, una de las naciones más beneficiadas por el tráfico de personas, lo hizo en 1807. Con todo, desde primeros de siglos, surgió en España, en el seno del primer liberalismo, un inicial movimiento en favor de la abolición del comercio de negros. Este artículo trata de tres hitos: la defensa de la abolición del comercio negrero por parte de Isidoro de Antillón en su (...) Disertación, leída en Madrid en 1802; los debates de las Cortes de Cádiz sobre la esclavitud, principalmente, el de la sesión del 2 de abril de 1811; finalmente, de la aportación a la discusión de José Mª Blanco White y la publicación en 1814 de su Bosquejo del comercio de esclavos. Abstract: Spain was the last of the old colonial empires to abolish the slave trade. England, one of the nations that most benefited from trafficking, did so in 1807. However, since the early century XIX, within the first liberalism an initial movement for the abolition of the slave trade emerged in Spain. This paper focuses on three milestones: the defense of the abolition of the slave trade by Isidoro Antillon in his Disertación, read in Madrid in 1802; the Cortes de Cadiz debates on slavery, mainly the session of April 2, 1811; finally, José María Blanco White's contribution to the discussion and the publication in 1814 of his Bosquejo del comercio de esclavos. RESUMEN: El presente artículo analiza el reforzamiento de la libertad de expresión que se produce cuando ésta es ejercida en conexión con el derecho de defensa, y se centra en un concreto supuesto que ha sido recientemente examinado por el Tribunal Constitucional: el ejercicio del derecho de defensa en primera persona por un funcionario que es objeto de un expediente disciplinario. A la vez que estudiamos la solución dada por el TC al citado caso, reflexionamos sobre los efectos de la (...) misma más allá del caso específico que resuelve, planteando la posibilidad de su extrapolación a la generalidad de supuestos donde el ciudadano ejerce su derecho de defensa en primera persona y sin asistencia letrada. Immanuel Kant is, famously, not only the major philosopher of European enlightenment, but also one of the first philosophers to develop a philosophical theory of “human races”. How do these two sides of Kant relate to each other? What is the significance of race in Kant’s philosophy? In this article, we aim to discuss these questions by taking a close look into the conceptual and philosophical presuppositions underlying Kant’s understanding of race; relating them to the concept of teleology as developed (...) by Kant in the Critique of Judgement and to the idea of natural history that can be derived from there. In the last two chapters, we intertwine both perspectives in such a way that, on the one hand, we can determine the philosophical significance of race for Kant, and, on the other hand, show how a race-sensible perspective gives new and critical insight into Kant’s concept of reason. In this paper I firstly examine the contents of Escur. Φ III 11, which includes a medical section, an anthology of texts both sacred and profane, and the epistolar exchange between Gregorius Acindynus and Eirene Choumnos. Secondly I go through Eirene’s intellectual background and the books transcribed under her patronage. Thirdly I explain the role played by this Escurialensis in Eirene’s library and in the anti-Palamite circles. In the first part of the paper, I present a framework for the description and evaluation of teleosemantic theories of intentionality, and use it to argue that several different objections to these theories (the various indeterminacy and adequacy problems) are, in a certain precise sense, manifestations of the same underlying issue. I then use the framework to show that Millikan's biosemantics, her own recent declarations to the contrary notwithtanding, presents indeterminacy. In the second part, I develop a novel teleosemantic proposal (...) which makes progress in the treatment of this family of problems. I describe a procedure to derive a (unique) homeostatic property cluster [HPC] from facts having to do with the properties that a certain indicator relied on, in the events leading to its fixation in a certain population. According to the homeostatic property cluster family of accounts, one of the main conditions for groups of properties to count as natural is that these properties be frequently co-instantiated. I argue that this condition is, in fact, not necessary for natural-kindness. Furthermore, even when it is present, the focus on co-occurrence distorts the role natural kinds play in science. Co-occurrence corresponds to what information theorists call redundancy: observing the presence of some of the properties in a frequently co-occurrent cluster makes (...) observations of other members of the cluster comparatively uninformative. Yet, scientific practice often, and increasingly often, singles out as natural groups of properties that are not redundant, but synergic: instantiations of properties in synergic clusters are not necessarily informative about instantiations of other properties in the cluster; rather, it is their joint instantiation that plays the explanatory role for which the natural kind is recruited. An appropriate framework is put forward for the construction of $$\lambda$$ -models with $$\infty$$ -groupoid structure, which we call homotopic $$\lambda$$ -models, through the use of an $$\infty$$ -category with cartesian closure and enough points. With this, we establish the start of a project of generalization of Domain Theory and $$\lambda$$ -calculus, in the sense that the concept of proof (path) of equality of $$\lambda$$ -terms is raised to higher proof (homotopy).

Each chapter of this dissertation develops a standard with which to evaluate and guide the improvement of a different node of a democratic system. In the first chapter, I consider the relationship between citizens, their environment, and the formal infrastructure of democracy. The standard for this node is democratic health, which is a feature of the social epistemic environment in which citizens operate. I argue that a democratically healthy environment is one that is conducive to the development of citizens’ epistemic (...) capacities to reason and communicate about their interests. I then demonstrate how political phenomena such as polarization pose social epistemic challenges to democratic health and argue that an epistemic conception of civic virtue can guide efforts to improve it. In the second chapter, I consider the relationship between representatives and their constituents under non-ideal conditions. The key standard for this node is systemic interest-responsiveness. I argue that observed public opinion and citizens’ values, commitments, and goals can stand in tension, and that representative democracies must be responsive to both factors. On this basis, I argue in favor of pairing independent administrative agencies with expanded forms of public input. In the third chapter, I consider how civic education can promote epistemic civic virtue. The key standard I develop here is the social epistemic public good. I argue that civic education can provide social epistemic benefits through its civic exchange function, which enables citizens to learn about the views and traditions of other citizens, and prepares them to effectively communicate with diverse others. Furthermore, I argue that this function can be pursued in the absence of widespread agreement about which values civic education should promote. (shrink)

El artículo aborda planteamientos que llegan a postular que la ciencia ha de rehacerse de nuevo, lo que se inscribe en un postulado mayor de que la edad moderna ha terminado y que estamos atravesando un período de transición. Así, no estaríamos solamente ante una crisis de los fundamentos del conocimiento científico, sino también del filosófico, y, en general, ante una crisis de los fundamentos del pensamiento. Se señala que abrirse a este examen crítico podrá poner en evidencia muchos vicios (...) de lógica que se han ido convirtiendo en hábito en amplios sectores de la vida académica. The Caribbean Philosophical Association’s project of shifting the geography of reason requires five specific commitments of attunement: (1) to the languages we use, (2) to our expressive and perceptive capacities, (3) to the communities in which we are engaged and the ones we aspire to engage within, (4) to building culture through political struggle, and (5) to our situatedness and irreducible interconnectedness. Each of these commitments is developed toward identifying the mutually constructive relationship between communicology and creolization.

Se propone un itinerario que comienza con la narración de algunas situaciones en las que se ponen de manifiesto preguntas que se antojan urgentes en estos tiempos: conflictos reales entre formas de valoración y acercamiento a la realidad con tintes en general muy violentos. A partir de la identificación de la noviolencia con ciertos procesos históricos y con personajes específicos, el autor se propone establecer en qué consiste y cómo podemos definirla adecuadamente como herramienta de análisis en sí misma, y en relación con lo que se denomina cambio social en las ciencias sociales. Propone finalmente a las ciencias sociales hacerse cargo del cambio social proveniente de la noviolencia como una categoría del proceso histórico y no un evento anormal en éste.

In the present paper we address the problem of optical isomerism embodied in the socalled “Hund’s paradox”, which points to the difficulty to account for chirality by means of quantum mechanics. In particular, we explain the answer to the problem proposed by the theory of decoherence. The purpose of this article is to challenge this answer on the basis of a conceptual analysis of the phenomenon of decoherence, that reveals the limitations of the theory of decoherence to solve the difficulties (...) posed by optical isomerism and, in general, by quantum measurement. Inconsistency toleration is the phenomenon of working with inconsistent information without threatening one’s rationality. Here I address the role that ignorance plays for the tolerance of contradictions in the empirical sciences. In particular, I contend that there are two types of ignorance that, when present, can make epistemic agents to be rationally inclined to tolerate a contradiction. The first is factual ignorance, understood as temporary undecidability of the truth values of the conflicting propositions. The second is what I call “ignorance (...) of theoretical structure”, which is lack of knowledge of relevant inference patterns within a specific theory. I argue that these two types of ignorance can be explanatory of the scientists’ rational disposition to be tolerant towards contradictions, and I illustrate this with a case study from neutrino physics. Using narrative descriptions of the author's own lived-experience of her ethnic heritage, Martinez offers a systematic interrogation of the social and cultural norms by which certain aspects of her Mexican-American cultural heritage are both retained and lost over generations of assimilation. Combining semiotic and existential phenomenology with Chicana feminism, the author charts new terrain where anti-racist, anti-sexist, and anti-homophobic work may be pursued.
